High Tide Escapes LLC. These Terms of Service ("Terms") govern your access to and use of our messaging services, websites, applications, and other products and services (collectively, the "Services"). By accessing or using our Services, you agree to these Terms, including the binding arbitration provision and waiver of class action rights in Section 9. If you do not agree to these Terms, do not use our Services.
By using our Services, you confirm that you are at least 18 years old or have been legally emancipated to enter into a contract, and that you accept these Terms.
Our Privacy Policy describes how we handle the information you provide to us when you use our Services. By using our Services, you agree that we can use such data in accordance with our Privacy Policy.
By opting into our messaging service, you consent to receive SMS messages (including text messages) from High Tide Escapes LLC, our agents, representatives, affiliates, or anyone messaging on our behalf for transactional purposes or for marketing and promotional purposes. Standard message and data rates may apply.
You have the freedom to cancel the SMS service at any time by simply texting "STOP" to the shortcode. Upon sending "STOP," our system will promptly confirm your unsubscribe status via SMS. Once unsubscribed, you will no longer receive SMS messages from us. To rejoin the program, you can sign up again in the same manner as your initial enrollment, and we will resume sending SMS messages to you.
The frequency of messages you receive will depend on your interactions with us and the preferences you set in your account.
You agree not to use the Services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the Services.
All intellectual property rights in the Services, throughout the world belong to us or our licensors, and the rights in the Services are licensed (not sold) to you. You have no intellectual property rights in, or to, the Services other than the right to use them in accordance with these Terms.
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
The Services are provided "AS IS" and "AS AVAILABLE" without any representations, warranties, or conditions of any kind, either express or implied.
To the maximum extent permitted by applicable law, High Tide Escapes LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
These Terms shall be governed by and construed in accordance with the laws of RI, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms will be resolved through binding arbitration, on an individual basis.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by updating the date at the top of these Terms and, where appropriate, notification via the Services or other means.
